Munley Law Personal Injury Attorneys Announces $4 Million Settlement with Shipping Company Responsible for Selecting an Incompetent Carrier
Munley Law Personal Injury Attorneys won a $4 million settlement for a client from a shipping company that selected an incompetent trucking company to transport its goods.
Munley Law Personal Injury Attorneys represented a couple that was severely injured in a multi-vehicle accident caused by one of the trucking company’s tractor trailers. According to the complaint, the accident occurred in a construction zone when a tractor trailer was unable to stop because its brakes were not properly adjusted. The truck rear ended the couple, causing a multiple vehicle collision. The accident left the couple with life-altering injuries, including paraplegia and severe back injuries.
According to the complaint, the truck carried the mandatory minimum insurance of $750,000.
“This settlement will go a long way to help our clients recover from such a horrific accident,” said Marion Munley, lead counsel on the case. It also sends a clear message to shipping companies to do their due diligence before selecting a carrier.”

Marion Munley and Daniel W. Munley received the American Association for Justice (AAJ) Trucking Litigation Group’s “Robert W. Munley Award” on Sunday July 12 during the AAJ’s virtual Annual Convention. Formerly the “Chairman’s Award,” the award was renamed this year in honor of the late Robert W. Munley (1930-2019). The award is presented annually by the Chair of the Trucking Litigation Group to an attorney who has done extraordinary work to further the group’s objectives: educating other lawyers on trucking law matters and contributing to the improvement of highway safety through legal work and advocacy.

IVC Filter Lawsuit Trial Starts This Week
The first case against medical device maker C.R. Bard goes to trial this week in Phoenix, AZ.
Over 3,000 lawsuits are pending against Bard in the United States. Plaintiffs allege that Bard’s IVC filter is unsafe and has been linked to serious complications and death. The bellwether trial, Sherr-Una Booker v C.R. Bard Inc. and Bard Vascular Inc, is scheduled to begin on March 13, 2018. Booker has alleged that her complications include filter tilting, fracture and perforation according to DrugWatch.com. We will be watching closely to see how this trial unfolds and what the implications may be for other victims seeking legal recourse.

On Tuesday, August 29, 2017, Atty. Daniel W. Munley along with paralegal, Jerome Levans, attended a crash test conducted by the Insurance Institute for Highway Safety (IIHS).
Each year, thousands of people are either killed or injured when a passenger vehicle collides with the side of a tractor-trailer. When a tractor-trailer is hit from the side, the advanced safety features of the passenger vehicle are not triggered because the passenger vehicle’s windshield is the first thing that comes into contact with the trailer.
