Q: What types of injuries are eligible for workers’ compensation?

In Pennsylvania, all types of work-related injuries are potentially eligible for workers’ compensation. If you got hurt on the job, with only limited exceptions, your employer is required to pay regardless of fault in the accident. For example, we have handled workers’ compensation cases involving:

Q: How long do I have to file a workers’ comp claim?

Under Pennsylvania law, you must notify your employer of your injury within 120 days of the accident in which your injury occurred. For occupational diseases, you have 300 weeks from your last date of employment to assert your legal rights. If you wait too long to file your claim, you could lose your rights entirely.

If you have a third-party claim (for example, if you fell because the owner of your employer’s office building failed to perform necessary maintenance), you may have up to two years to file your claim for compensation. However, for several reasons, it is still important that you speak with an attorney as soon as possible.

If you intend to file for workers’ compensation, you must see an approved doctor for your first 90 days of treatment. Your employer should give you a list of doctors to choose from.
