A jury awarded $2 million to our clients, the estate of a car accident victim whose fatal crash was caused by a reckless truck driver in an oversized and unpermitted tractor trailer.
According to the case facts, the victim was struck by a tractor trailer making a reckless left-hand turn from a stop sign. The force of the impact caused the victim’s car to roll over on the driver’s side, entrapping the driver. The driver suffered an immediate and extensive traumatic injury, resulting in his death.
He left behind a wife and child. The victim’s wife lost not only her husband but future income and benefits with his death.
Representing the plaintiff’s estate and the victim’s wife, the tuck accident attorneys at Munley Law made the case that the semi-tractor trailer was oversized and overweight and that the defendant did not have the necessary state permits to operate the vehicle.
In addition, the defendant:
- Operated his vehicle in a negligent, careless, and reckless manner
- Turned without proper clearance at the stop sign
- Was texting while driving
- Was fatigued while driving
- Did not use a sign to indicate the size and weight of the vehicle
- Did not have a police escort or pilot vehicle for the oversized vehicle
- Did not have adequate lighting, reflectors, or tape on the vehicle to make it more visible
By holding the driver and his employer responsible, Munley Law helped this family find peace of mind after tragedy. The $2 million judgment in this case brought needed accountability for the truck accident and gave the victim’s family some financial relief for their losses.
