Why Choosing an Atlanta Lyft Accident Attorney Is So Important

In Atlanta, car accidents, including those involving Lyft, occur daily. Data from the Georgia Governor’s Office of Highway Safety reveals the number of traffic fatalities in the eleven counties making up the Atlanta region increased by 5% from 499 in 2019 to 523 in 2023. As a local law firm, we understand the dangers of Atlanta roadways and the risks drivers take every time they get into a vehicle and trust the person in the driver’s seat.
Our Atlanta Lyft accident attorneys have helped victims suffering needless injuries due to express lane aggressiveness and fatigued drivers behind the wheel during rush hour traffic. Most importantly, our Atlanta Lyft accident lawyer has helped victims to get fair compensation in these challenging cases. You can trust us to do the same for you.
For almost seven decades, we’ve successfully pursued personal injury, property damage, and other claims for accident victims. Among these are a $17.5 million jury verdict for a teen’s death caused by a car accident, a $6.9 million settlement when a garbage truck crashed into a car, and a $4.4 million settlement in a car accident case.
All our lawyers are members of the American Association for Justice (AAJ). Partner Marion Munley is currently the Vice President of the AAJ, which has honored our lawyers with various awards. Additionally, Robert Munley III, Caroline Munley, and Marion Munley are members of the Million-Dollar and Multi-Million Dollar Advocates Forums, and the National Trial Lawyers Association named J. Christopher Munley to the Top 25 Motor Vehicle Trial Lawyers list.
We will draw on our more than 250 years of legal experience to assess your claim, build your case, and pursue justice. With us, you get a legal team you can trust to have your best interests at heart.

Why Is Getting Compensation in a Lyft Case in Atlanta Challenging?
As you move deeper into your accident case, you may find that filing a claim with Lyft directly is frustrating and, in many cases, overwhelming. Notably, the company offers app-based evidence collection and wants you to simply upload images and file a claim through the app. Doing so is not ideal and can seriously harm you in the long run. That is just one example of how Lyft cases in Atlanta can become more challenging. Other common reasons include:
-
Lyft does not want to pay any claims. They will make it far more challenging for victims to recover losses if they do not have legal representation. They may deny your claim, require endless amounts of medical documentation, or try to shift the blame to your shoulders.
-
The burden of proof is on your shoulders. Under Georgia law, O.C.G.A. § 51-12-2(b), the victim must prove what their losses are. The plaintiff does not have to be proven innocent. As a direct result of this, victims are often given a much too heavy load in trying to find evidence to back up their claims.
-
You are not given all the information unless you demand it. While Georgia courts will listen to motions for access to sensitive data, such as medical records from the driver, getting that information to prove your case is challenging. A lawyer can minimize those risks.
There is no average settlement for an Atlanta Lyft accident. The value of your claim and your ability to recover it are dependent on your ability to know and use Georgia personal injury law to your benefit. Learn more about our success stories by reading our client testimonials.
How Georgia’s Comparative Negligence Rule Affects Your Lyft Claim
In Georgia, you can still recover compensation if you were partly at fault for the accident — as long as your share of the blame is less than 50%. Georgia follows a modified comparative negligence rule under O.C.G.A. § 51-12-33. Your recovery is reduced by your percentage of fault, and if you are found to be 50% or more responsible, you cannot recover anything.
For example, if your damages total $100,000 and you are found 20% at fault, your recovery is reduced by 20% to $80,000. But if you are found 50% or more at fault, you recover nothing. This is exactly why Lyft and its insurers work to shift as much blame onto you as possible — every percentage point they assign to you lowers what they pay, and pushing you to 50% eliminates your claim entirely. Our Atlanta Lyft accident lawyers gather the evidence and build the argument needed to keep your share of fault as low as the facts allow.
Determining Compensation In a Lyft Accident in Atlanta
When it comes to determining compensation, Lyft accidents are no different from other car accidents. The person who causes the incident to occur is often at fault for the losses incurred by others. This is complicated in Lyft accidents because Lyft drivers are not actual employees of the rideshare company. As a result, Lyft is only responsible in some situations, such as when the driver has accepted a ride and is providing services to customers through the app.
Numerous parties could be at fault in a Lyft accident in Atlanta, including:
- The Lyft driver
- Lyft itself, if there was an in-app service being provided at the time
- Other drivers on the road
- Another company or third-party
- The city or government agency that failed to keep you safe
Lyft maintains $1 million liability insurance policies on its drivers for situations in which their driver causes serious injuries while providing services. However, drivers must carry at least $100,000 in liability insurance to cover claims when they are logged into the app but not providing a service.
Lyft Laws in Atlanta, Georgia
In Georgia, rideshare companies are referred to as Transportation Network Companies (TNC). The regulations governing TNCs differ from those for standard drivers. These Georgia Public Service Commission rideshare rules have several specific factors that you should understand before you move your case or claim forward:
- Endorsements: State and municipal rideshare regulations require rideshare drivers to obtain a “for hire” endorsement for their license or be certified by the rideshare company as being competent to drive.
- Background check: Direct background check requirements are in place. That is, Lyft is responsible for completing both a criminal background check and a driving record check before allowing any driver to operate with the company.
- Age: All rideshare drivers must be at least 21 years of age
Drivers must also have appropriate commercial insurance coverage. Under O.C.G.A. § 33-1-24:
- If the TNC app is on, the driver is available to accept rides: The minimum bodily insurance and property damage liability insurance drivers must have is $100,000 for all persons in any one accident, with a maximum of $50,000 for injuries to one person. An additional $50,000 minimum property damage policy is necessary.
- If the TNC has accepted a ride and is transporting a passenger, bodily injury and property damage liability increases to a minimum of $1 million per occurrence. Underinsured and uninsured motorist coverage is also required.
These are some of the differences in personal vs. commercial use distinctions for Lyft drivers. In Atlanta, if you are planning to use a Lyft service, you need to know who is going to cover your losses. Even if they are responsible, insurance companies will still fight to lower the amount of compensation paid to you.
Accident Types Involving Lyft Drivers
Motor vehicle accidents in Atlanta include a wide range of preventable incidents. Some of the most common causes of accidents with Lyft drivers include:
- Distraction with phones, conversations, food, or daydreaming behind the wheel
- Reckless driving, including illegal lane changes, speeding, and tailgating
- Intoxication, including from alcohol or drugs
- Mechanical failures from vehicles that lack maintenance
- Fatigue due to long hours worked on the job
- Inexperience, noting that Lyft drivers have no specialized training for their service
We gather evidence to build your case from all possible sources. This includes witnesses, dashcam footage, police reports, accident reconstruction, and expert testimony. Our Atlanta Lyft accident lawyers are aggressive in seeking all data possible to build your case.
What Should I Do After a Lyft Accident?
In many ways, the steps you take immediately after being involved in a Lyft accident can make or break your case. Our Atlanta Lyft accident lawyers recommend that you:
- Contact emergency services and law enforcement: Assess the scene and call emergency services, even if no one appears to be visibly injured. According to O.C.G.A § 40-6-273, you must report the accident to law enforcement immediately if there are injuries, fatalities, or property damage worth $500 or more.
- Document the accident scene: Take photos or video footage of the accident scene. Pay attention to the position and state of the vehicles, the road and weather conditions, and anything that may have contributed to the accident.
- Obtain a record of your injuries: If you have been injured, ask emergency services personnel to provide you with documentation of your injuries. Additionally, use your phone to take photos or videos of your injuries.
- Report the accident to Lyft: If you are a passenger in the Lyft vehicle, use the app to report the accident to the company as soon as possible. Take a screenshot of your ride in the app as proof that you were in the vehicle at the time of the accident. The company may contact you for more information and launch its own investigation. If so, be honest without providing additional information.
- Gather evidence: Ask all parties involved in the accident for their contact details and insurance information, and ask witnesses for their contact details and a brief account of what they saw. Keep your conversation with others to a minimum and avoid admitting fault. If law enforcement is on the scene, ask them for a copy of the police report.
- Contact a Lyft accident lawyer: Speak to one of Munley Law’s Lyft accident attorneys as soon as possible, as they can provide valuable guidance, help you understand your rights, and fight for justice on your behalf.
- Report the accident to your insurance company: Contact your insurance company and report the accident. Your insurance provider should cover your medical expenses and property damage according to your policy limits. Be honest with the company without volunteering additional information or explaining your answers.
- Document your experience after the accident: Keep a detailed record of how your life is impacted after the accident. This should include work you miss, earnings you lose, ongoing medical treatment, or other impacts or expenses. Your lawyer can use this record when valuing your claim and fighting for compensation.
As the multi-million-dollar settlements and verdicts we’ve gained for accident victims prove, it’s not impossible to claim compensation after being involved in a Lyft accident in Georgia. Entrust your case to Munley Law’s award-winning lawyers.
Which Accident Injuries Are Commonly Associated with Lyft Driver Recklessness?
You trusted the person driving the vehicle to get you there safely. They failed. You have emotional, physical, and financial losses. We do not recommend simply settling your case. This is especially true when you have serious injuries. Over years of helping victims pursue justice and seek compensation, we’ve seen the following injuries associated with Lyft driver recklessness:
- Traumatic brain injuries
- Spinal cord injuries
- Broken bones or crushing accidents
- Lacerations

If you went to any of Atlanta’s hospitals after your accident, such as Emory University Hospital or Northside Hospital, we strongly recommend focusing solely on your recovery. Let our attorney handle the claims process while you heal.
Frequently Asked Questions in Atlanta Lyft Accident Cases
Are There Damage Caps for Lyft Accident Cases in Georgia?
Yes, Georgia has a $250,000 punitive cap on all damages claims. However, there are statutory exceptions, such as product liability, DUI, and specific intent to harm, where the cap does not apply.
Where Should I Report a Lyft Accident in Atlanta?
If the accident occurs within Atlanta city limits, call 911 and request assistance from the Atlanta Police Department. The responding officer will typically prepare an accident report if there are injuries, significant property damage, or other circumstances requiring documentation. If the crash occurs outside city limits, another agency, such as the Georgia State Patrol or the relevant county police department, may respond. You should also report the accident through the Lyft app as soon as possible.
What Areas of Atlanta See the Most Lyft Accident Traffic?
Lyft accidents are more common in some of Atlanta’s busiest traffic corridors, including Downtown, Midtown, Buckhead, and areas surrounding Hartsfield-Jackson Atlanta International Airport. High-volume routes such as I-75, I-85, I-20, the Downtown Connector, Peachtree Street, and Northside Drive frequently experience heavy rideshare traffic. If your accident occurred in one of these locations, nearby traffic cameras, business surveillance footage, and witness accounts may provide valuable evidence for your claim.
How Long Do I Have to File a Lyft Accident Claim in Georgia?
You have two years from the date of the accident to file a personal injury lawsuit in Georgia, under O.C.G.A. § 9-3-33. For property damage claims, you have four years, under O.C.G.A. § 9-3-32. If you miss the deadline that applies to your claim, the court will likely dismiss it, and you will lose your right to recover.
If the injured person was under 18 at the time of the accident, the deadline is tolled. Under O.C.G.A. § 9-3-90, the two-year clock generally does not begin until their 18th birthday, giving them until age 20 to file. Other exceptions can shorten or change these deadlines. For example, claims against a city or county government carry much shorter notice requirements.
