What Is Your Atlanta Uber Accident Worth?
Under Georgia law, you have the right to pursue compensation for any losses you have. The value of your Atlanta Uber accident case is dependent on numerous factors, including the seriousness of your injuries, the underlying cause of the accident, and your ability to prove those factors.
Uber accidents in Atlanta can be very expensive, especially in those that happen in high-traffic areas such as I-20 and I-85, where fast-moving traffic can cause life-threatening injuries. The value of your case is dependent on the losses you have, such as:
- Medical expenses from the accident and through your recovery
- Ongoing health care and support needs throughout recovery
- Loss of income from being unable to work for a period of time
- Loss of earning capacity if you have long-term injuries
- Pain and suffering
- Emotional trauma
Local Atlanta courts can be challenging when it comes to proving non-economic damages, such as pain and suffering. Yet this is a critical component in providing you with the compensation you need to rebuild your life. Our highly experienced Uber accident attorneys in Atlanta know how to present detailed evidence about your losses, document the impact on every facet of your life, and prove to the court what your losses are. You can find more information in our car accident FAQs.

Uber Accident Laws in Atlanta and Georgia You Should Know
Our extensive experience in recovering damages in an Uber accident stems from our comprehensive understanding of the laws in place here. In Georgia, rideshare companies are referred to as Transportation Network Companies (TNCs). There are specific TNC regulations applicable to this group of drivers that are enforced by the Georgia Department of Public Safety. Among these rules are the following:
Drivers must have an endorsement on their license as a “for hire” driver or be certified through a background check that the rideshare company conducted.
Driver background check requirements are meant to keep passengers safe. Uber is required to conduct a full background check to review the driver’s criminal history as well as their driving record.
All Uber drivers must be at least 21 years of age.
All drivers must operate vehicles that pass a safety inspection performed at a certified inspection site.
Uber insurance policies must be in place that cover their drivers. The amount of coverage ranges based on the driver’s actions at the time of the incident. All drivers must also maintain personal auto insurance that meets the state’s minimum coverage requirements.
According to O.C.G.A. § 33-1-24:
- An Uber driver must have at least $100,000 bodily insurance and property liability insurance for all persons in any one accident, with a maximum of $50,000 for injuries to one person, if the TNC app is on and the driver is available to accept rides. They also need an additional $50,000 minimum property damage policy.
- If the driver has accepted a ride and is transporting a passenger, they need at least $1 million bodily injury and property liability insurance. They also need underinsured and uninsured motorist coverage.
Why Recovering Fair Compensation Is Challenging for Uber Accident Victims
Uber accidents can change the course of a person’s life in an instant. They happen for numerous reasons. Some of the most common include distracted driving, fatigue, and reckless driving. What makes them more challenging is the process of determining who should pay for your losses.
Uber accidents are treated differently from a simple car accident. The complication comes in how liability is attributed in the accident. Georgia rideshare companies must have insurance on the drivers they have, but there are a few factors we must consider to determine if Uber or the driver should pay for your losses.
If the Uber driver is logged into the Uber app and providing a service at the time of the accident, Uber’s liability insurance may cover your injuries and losses. Uber’s $1 million policy is much larger than what the average accident will involve. However, if the Uber driver is not actively providing a ride through the app, that high level of coverage may not be present. Rather, you will need to file a claim against the driver’s insurance. In line with the law mentioned above, Uber requires drivers to maintain a policy with at least $100,000 of liability protection.
Will Uber Try To Limit the Compensation I Claim?
Even when you have a valid claim to make against Uber, you can expect the rideshare company to do what it can to fight you on recovering those damages. The insurance company will put significant pressure on you to prove every detail, and, in some situations, you may find it very difficult to get them to approve your claims.
Our goal as Uber accident lawyers is to simplify the process and protect your future. When you meet with our lawyers, we will gather as much evidence as possible to build your claim and back it with evidence to minimize denials. If your claim has already been denied, we still may be able to help. Meet with us and let us discuss your legal options with you now. Learn more about us today.
Fault and Liability Under Georgia Laws for Uber Cases
To seek compensation under Georgia laws for your Uber case, our car crash attorneys must work to understand the details of the incident, including what happened at the time of the accident. In a rideshare accident case, one or more parties could be at fault. Here are some examples of how Atlanta courts handle these claims:
- When does Uber pay for your losses? If you are using an Uber service that is registered within the Uber app the driver is using, and the driver causes an accident, Uber’s liability insurance often pays for your losses. That means we file your claim with Uber and work to secure compensation.
- When does the driver pay for your losses? If the driver who caused the accident did not have a ride at the time of the incident, even if they were logged in and waiting for a ride, the driver’s liability insurance may be responsible for your losses.
- Could another person be at fault for your losses? Our Atlanta Uber accident lawyers will work diligently to uncover any other party that could be responsible. This may include other drivers, employers of other drivers, and even the city, in some cases.
In these situations, the more we know about your accident, the easier it is for us to demonstrate to the courts who should be held responsible.
What Should I Do If I’m Involved in an Uber Accident in Atlanta?
We know how frightening, disorienting, and upsetting a motor vehicle accident can be. However, if you’re involved in an Uber accident in Atlanta, it’s important that you take specific steps in the aftermath to protect yourself, your rights, and any claims you might decide to file. These steps include:
- Contact Emergency Services: Call 911 and report the accident, even if no one has visible injuries. As some injuries only become apparent later, it’s important that you and other victims are examined by medics. If you’ve been injured, ask the medics for a copy of the report that links your injuries to the accident.
- Contact Law Enforcement: Under C.G.A § 40-6-273, you’re required to report the accident to law enforcement if there are injuries, fatalities, or property damage worth at least $500. You’re also required to remain at the scene until the police arrive. Even if none of the conditions are present, it’s a good idea to report the accident, as a police report can help strengthen your case.
- Document the Accident Scene: Take video footage and photos of your injuries and the accident scene, including the positions and location of the vehicles, traffic and weather conditions, signage, and the condition of the road.
- Speak to Witnesses: Keeping your conversation to a minimum, speak to any witnesses. Ask them for their contact details and a short description of what they saw. Do not admit fault when speaking to them.
- Report the Accident to Uber: If you were a passenger in the Uber vehicle, report the accident to the company through the app as soon as possible. Screenshot your ride in the app to prove you were a passenger at the time of the accident. If the company contacts you for more information, be honest without divulging additional information or explaining your answers.
- Contact an Atlanta Uber Accident Lawyer: Call or email an Atlanta Uber accident lawyer at Munley Law as soon as possible for guidance, to learn more about your rights, and to start building your case.
- Report the Accident to Your Insurance Provider: After speaking to a lawyer, report the accident to your insurance company, which will cover your medical and other expenses according to your policy limits.
- Document Your Experience After the Accident: Keep a detailed account of how the accident affected your life. This should include any ongoing medical treatment or care, medication, rehabilitation, lost wages if your injuries prevented you from returning to work, chronic pain, or emotional distress such as post-traumatic stress disorder (PTSD). This record will help your lawyer value your claim.
While you’re not required to file a personal injury or property damage claim immediately, it’s important to remember Georgia’s statute of limitations. Under O.C.G.A § 9-3-32 (2024), you have two years from the date of the accident to file a personal injury claim and four years to file a property damage claim. You don’t need to do this on your own. The legal experts at Munley Law will guide and support you throughout the entire process.

Causes of Uber Accidents in Atlanta
In Atlanta, Uber accidents can happen for any reason that can trigger a typical car accident. There are several factors that contribute to their increased prevalence and, in some cases, severity. In Atlanta, some of the most common causes of Uber accidents we see include:
- Distracted drivers, especially those using their app for navigation, are getting into accidents as a result.
- Driver fatigue is common among those who spend a great deal of time on the road working their Uber side businesses.
- Poorly maintained vehicles, as there are so few oversights to monitor the condition of the vehicles.
- Drivers under the influence of drugs or alcohol.
- Traffic congestion, especially in common Uber pick-up and drop-off areas such as Virginia-Highland and East Atlanta Village, the airport, Midtown, and Buckhead.
- Speeding and reckless driving are often the cause of many of the roadway accidents in the city.
With so much congestion, reckless driving, and confusion from drivers who may not have extensive experience behind the wheel, Uber accidents are not uncommon. Yet, victims of these accidents deserve fair compensation from insurance companies. Let us go to work for you to make sure you get it.

Common Questions About Atlanta Uber Accidents
Every case is unique, meaning we cannot provide blanket answers for many questions. However, we’d like to shed light on some frequently asked questions regarding Atlanta Uber accidents.
How Long Do I Have to File a Claim for My Atlanta Uber Accident?
Under Georgia’s statute of limitations, victims have two years from the date the accident took place to seek financial compensation. Do not wait to contact us to start the process.
Should I Use the App to Submit My Claim?
We do not recommend submitting a claim through the app. Though Uber may offer an app-based evidence collection process and will prompt you to complete the accident form, do not do so until you speak to our legal team. Mistakes here could cost you significantly.
How Much Does an Uber Accident Lawyer Cost?
At Munley Law Personal Injury Attorneys, our legal team works with you from the start without any pressure or financial frustration. We provide you with a free consultation to get to know us, and we can get to know a bit about your case. If you agree to move forward, we will begin working on your case right away.
You won’t pay us anything up front. You don’t pay anything out of pocket at all. We only get paid if we win your case. With a strong local success rate, you can trust us to build a very comprehensive and detailed claim, and if needed, to fight for you to recover damages in a court of law. You only pay us after you win your case and collect damages.
Do I Need to Speak to Uber’s Insurance Adjuster After the Accident?
No, you don’t. You shouldn’t speak with the company’s insurance adjuster before consulting one of our Uber accident lawyers. Adjusters may appear sympathetic, but their goal is to limit the company’s financial responsibility. They might ask leading questions, request recorded statements, or pressure you into accepting a low settlement early on. We will handle all communication with Uber and its insurance company on your behalf, protecting your rights and fighting for the compensation you deserve.
Can I File a Claim if I Wasn’t Wearing a Seatbelt in the Uber?
Yes, you can still file a claim for compensation if you weren’t wearing a seatbelt at the time of the accident. Georgia’s modified comparative negligence rule means your compensation may be reduced if you’re found partially at fault, but this doesn’t bar you from recovering damages. Our lawyers will work to minimize any fault assigned to you and prove the driver’s or Uber’s liability so you can seek the maximum compensation allowed under Georgia law.
Can I Still File a Claim If the Uber Driver Was Not at Fault?
Yes, you can. Many Uber accidents are caused by other negligent drivers, not the rideshare driver. In these cases, claims can be filed against the at-fault driver’s insurance. Additionally, your Uber injury may still be covered by the rideshare company’s underinsured/uninsured motorist policy. Our Atlanta Uber accident lawyer will investigate the accident, review police reports, speak to experts and other witnesses, and determine every party potentially responsible, ensuring no source of compensation goes undetected.
How Long Does It Take to Settle an Atlanta Uber Accident Case?
Every Uber accident case in Atlanta is different. The settlement timeline depends on various factors, such as the severity of your injuries, the cooperation of the insurance company, and whether the case needs to go to court. We’ve seen some claims settled within a few months, while others have taken a year or more. Our lawyers will keep you informed throughout the process, working to recover fair compensation as efficiently as possible.
