How Much Do Wrongful Death Cases Settled For

Wrongful death settlements vary enormously, so there is no reliable “average” figure that predicts what a particular case will settle for. The value depends on factors such as the deceased person’s age, income, earning potential, family circumstances, medical and funeral expenses, the strength of the liability evidence and the insurance or assets available to pay a judgment. State law also determines which damages survivors or an estate may recover. A death involving a high-income parent with dependants, for example, may create substantially different economic losses from another case, even if the underlying accidents appear similar. Some cases resolve within available insurance limits, while serious commercial vehicle, medical negligence or product cases may involve multiple defendants and substantially greater coverage. Settlement databases and headline verdicts can be misleading because they do not capture the facts of an individual claim. A meaningful valuation requires calculating the recoverable losses under the applicable state law and assessing liability, evidence and available sources of compensation.
