Most commercial trucks are equipped with an EDR that continuously records vehicle data. Depending on the make and model, this typically includes vehicle speed in the seconds before impact, hard braking events, engine RPM, throttle position, seatbelt usage, and GPS location. Some trucks also record hours-of-service data through an Electronic Logging Device, which is required under FMCSA regulations and shows whether the driver was in compliance with federal driving-hour limits at the time of the crash.
The problem is that black box data is not stored indefinitely. Many systems overwrite earlier data after a relatively short period — sometimes within days. If you do not act quickly, that information can be gone before anyone knows it existed.
This is why one of the first actions a truck accident lawyer takes is filing a legal motion — often a temporary restraining order — to prevent the trucking company from accessing, altering, or destroying the truck’s data. Trucking companies know how valuable this information is. Without legal intervention, there is no guarantee they will preserve it voluntarily.
