Truck accident attorneys Daniel W. Munley and Marion Munley obtained a $26 million settlement for a single mother of three who was critically injured when a tractor trailer collided with her car, causing a chain reaction crash.
Our client was driving to work and was stopped in the right lane due to traffic caused by an accident on an exit off-ramp and construction. A few minutes later, a tractor trailer violently struck her vehicle at full speed. The force of impact propelled our client’s car into the rear of the car in front of her. After the collision, the tractor trailer continued to move, pushing the victims’ car off the shoulder of the interstate and into a drainage ditch. The plaintiff was trapped in her vehicle.
The serious injuries from the accident included multiple trauma, traumatic brain injury, injuries to the spinal cord, quadriplegia, pulmonary embolism, and many others, which caused her great pain and physical and mental suffering and forced her to undergo extensive medical treatment. The injuries impacted her ability to work and conduct routine leisure activities.
On behalf of the plaintiff, Munley Law alleged that the truck driver and his employer were negligent and reckless. Evidence showed that the driver was operating the fully loaded tractor trailer while distracted or fatigued, not only driving too fast but failing to keep an eye on the roadway and brake or steer away from the collision.
As a result, he violated several state and federal laws and regulations. The plaintiff sought damages for her pain and suffering, medical care, her inability to work, and her diminished quality of life.
In this tragic vehicle accident, a woman minding her own business and abiding by the law was indelibly impacted by the careless actions of a commercial driver. With Munley Law’s expertise in truck accident law, we delivered justice on her behalf with damages that fairly reflected the catastrophic event. While no amount of money can undo the pain and suffering, this outcome allowed for a life care plan and can at least help the plaintiff find closure.
