What is an Excess Judgment?
An excess judgment occurs when a court awards a verdict against an insured defendant that is larger than the available limits of that defendant’s insurance policy, leaving the insured personally responsible for the difference. In some cases, an insured or assignee may pursue the insurer directly if it unreasonably failed to settle within policy limits.
