Can I still win if there were no witnesses or I did not take photos?
Yes. Eyewitnesses and scene photographs can be helpful, but they are not the only ways to prove what happened. Police reports, 911 recordings, nearby surveillance or dashcam footage, vehicle damage, electronic data, business records, inspection logs, medical findings, admissions, and expert analysis may help establish fault and causation.
Your own testimony can also be evidence, although insurers may challenge it. Consistent medical treatment and prompt documentation often become especially important when direct scene evidence is limited. An early investigation gives counsel the best opportunity to locate alternative proof before it is lost or destroyed.
