Can I sue for emotional distress after an accident?
Emotional harm may be included in a personal injury claim when it flows from a physical injury—for example, anxiety, sleep disruption, fear, depression, or trauma caused by a serious crash. Medical and mental-health records, testimony from treating professionals, and evidence of changes in daily life can help establish the nature and duration of the harm.
A stand-alone claim for negligent or intentional infliction of emotional distress is different and is governed by specific Pennsylvania elements and limitations. Distress alone does not automatically create a separate lawsuit. A lawyer should evaluate the conduct, your relationship to the event, physical effects, treatment, and the available proof.
