What happens if my medical bills are higher than my settlement?
A settlement does not automatically erase medical bills. The outcome may depend on liability limits, other available policies, health-insurance payments, Medicare or Medicaid recovery rights, workers’ compensation, provider balances, and valid liens or reimbursement claims. Some obligations may be negotiable, but reductions are not guaranteed.
Before funds are distributed, the legal team should identify outstanding claims and provide a written accounting of fees, costs, liens, and the client’s net recovery. If coverage appears inadequate, counsel can investigate additional defendants, underinsured-motorist coverage, or other lawful sources while avoiding a settlement that overlooks enforceable repayment obligations.
