How Much Is a Truck Accident Case Worth?

There is no single formula for a truck accident settlement. The value of your case depends on the severity of your injuries, your medical expenses, lost wages, and the strength of the evidence against the responsible parties. In this video, triple board-certified truck accident attorney Marion Munley explains how case value is determined.

What You’ll Learn

  • How current and future medical expenses factor into your total claim
  • What lost wages and lost earning capacity mean for long-term cases
  • How pain and suffering damages are calculated in truck accident claims
  • When punitive damages may be available — and what triggers them

Economic damages are the starting point. These include your current and future medical expenses — hospital stays, surgeries, physical therapy, prescription medications, and any long-term care your injuries require. Lost wages are also calculated: income you have already missed and projected future earnings if your injuries have affected your ability to work. In catastrophic injury cases involving paralysis, traumatic brain injury, or permanent disability, these figures can reach into the millions.

Non-economic damages account for pain and suffering, emotional distress, loss of enjoyment of life, and the impact your injuries have had on your relationships and daily functioning. These are harder to quantify but can represent a significant portion of the total claim, particularly in cases involving severe or permanent injuries.

Liability also affects value. If the trucking company committed serious violations — falsifying hours-of-service records, operating a vehicle with known brake failures, or ignoring prior safety complaints — punitive damages may also be available.

Munley Law’s truck accident results include $26 million for a client who suffered a brain injury in a tractor-trailer crash, $19.8 million for the family of three killed by a distracted truck driver, $11 million for a client rear-ended by a tractor-trailer in a construction zone, and $9.95 million for a woman struck head-on by a commercial truck.
