Munley Law obtained a settlement of $1.35 million for a client who was critically injured when his car was hit by a driver who fell asleep at the wheel.
In this case, the plaintiff suffered greatly at the hands of a negligent driver, and the insurance policy was woefully inadequate. We ultimately delivered a settlement to our client more in line with the seriousness of his injuries and losses.
The Effects of the Car Accident On Our Client
The plaintiff was driving his vehicle in the southbound lane on an area roadway when the defendant hit him head-on. It was later revealed that the other driver had fallen asleep at the wheel, causing the car to cross the double yellow line into the plaintiff’s lane, which resulted in the collision.
The plaintiff was entrapped in the wreckage following the accident and sustained life-threatening injuries to the anterior tibial and peroneal arteries, causing a stroke. He also suffered serious injuries, including fractures to his femur, tibial, and patellar and deep lacerations to the leg.
In this traumatic accident, a man’s life was forever altered by the carelessness of an unlicensed driver. The plaintiff’s vast medical treatment consisted of multiple surgeries, extensive rehabilitation, and continued care. The injuries have greatly impacted his daily routines and leisure activities.
How Munley Law Handled the Car Accident Case
On behalf of the plaintiff, Munley Law presented a claim with the defendant’s insurance company. Using evidence collected at the scene of the accident, our car accident attorneys alleged that their insured was asleep at the wheel. In addition, their driver received citations for the following violations:
- Driving on roadways laned for traffic
- Driving on the right side of the roadway
- Accidents involving death or personal injury
- Driving without a required license
As a result, the insurance company tendered its policy limit. Munley Law then pursued additional coverage available under the Plaintiff’s auto insurance, concluding underinsured coverage. They also settled for the maximum limit available.
Although no amount of money can erase the pain and suffering endured, the expertise of Munley Law’s pre-litigation team provided compensation and closure for the plaintiff.
