Dan Munley Featured on SiriusXM Road Dog Trucking Radio

Truck accident attorney Daniel W. Munley was recently featured as a guest on “On the Move with Dan Ronan”, airing on SiriusXM Road Dog Trucking Radio (Ch. 146). Munley joined host Dan Ronan to discuss the legal implications of the U.S. Supreme Court’s unanimous decision in Montgomery v. Caribe Transport II, LLC, a landmark ruling that allows injured parties to bring state negligence claims against freight brokers for negligently hiring unsafe motor carriers.

The May 14, 2026, ruling resolved a long-contested legal question about whether the Federal Aviation Administration Authorization Act (FAAAA) preempted state tort claims against brokers. The Supreme Court held that it does not, allowing cases to proceed in state courts when a broker’s carrier selection contributed to a truck crash.

Dan, who has lobbied Congress on trucking safety issues and tried truck accident cases across the country, offered a measured read on what the ruling means in practice. “I really think that if anybody is saying there is going to be a deluge of lawsuits because of this, I don’t think that’s the case at all,” Munley told Ronan. “The vast majority of brokers in the trucking industry operate within the bounds of decency. It’s the ones on the periphery, the ones who made bad decisions about who to hire, that we’re hearing about in these cases.”

He made clear, however, that when brokers knowingly select carriers with poor safety records, accountability follows. “If they’re out there hiring bottom feeders, they should be sued,” he said. “I’ve sat across the table from a spouse who lost her husband and was left with three young children to educate, feed, and house for the next 15 years, with a $750,000 insurance policy that couldn’t replace what was lost. When you see that a broker picked a carrier with an abysmal safety record, it’s my opinion they should be held accountable. The Supreme Court has now said that can be done.”

Dan also addressed the trucking industry’s long-standing mandatory minimum insurance requirement, which has remained at $750,000 since the Reagan administration, a figure that has not been adjusted in more than 40 years. He described his involvement in a Congressional lobbying effort around 2010 to 2012 to raise the minimum, which drew fierce opposition from smaller carriers and the Owner-Operator Independent Drivers Association (OOIDA) and ultimately failed to advance.
