$750k settlement for truck accident victim
Victim to receive compensation for injuries sustained in truck accident
Munley Law Personal Injury Attorneys announced Friday that a $750,000 settlement has been reached in a tractor trailer accident case which was scheduled to go to trial this month before the Honorable Robert D. Mariani, United States District Court Judge for the Middle District of Pennsylvania in Scranton.
Robert W. Munley III noted that “Our client brought this lawsuit to achieve justice for the suffering and trauma that he and his family have endured since this accident. We have been honored to represent him, and we hope that this settlement will help not only our client but will go a long way towards improving safe driving conditions for truckers and drivers alike.”
Mr. Munley represented plaintiff Henry Calhoun, a Florida tractor-trailer driver who was seriously injured when his parked vehicle was struck by another tractor-trailer in June 2011. Calhoun was in the sleeper berth of his truck in a Luzerne County parking lot when the accident occurred. Defendant Stephen Van Loon, a driver for New Prime, Inc., backed up and collided with Calhoun’s vehicle.
Upon impact, the Munleys’ client was thrown from the sleeper berth ladder, causing him to fall and sustain significant injuries to his back and leg which required surgery. Munley Law Personal Injury Attorneys argued that Van Loon and New Prime failed to follow standard safety procedures in the course of operating the vehicle at the time it struck Calhoun’s truck.
The settlement will help to cover Calhoun’s past, present and future medical bills and will supplement his diminished earning capacity as a result of the injuries sustained in the accident.
The case is Henry Calhoun and Tanya Calhoun vs. New Prime, In., d/b/a/Prime, Inc. and Stephen Van Loon. No. 3:CV-12-0458 US District Court for the Middle District of Pennsylvania.
