Insurer

What is an Insurer?

An Insurer is, “the underwriter or insurance company with whom a contract of insurance is made.” (Black’s Law Dictionary 946. 4th Ed. Rev. 1968). It is important not to confuse the insurer with the insured. The insurer is the party offering insurance, while the insured is the individual who receives insurance (the policyholder). Usually the insurer is an insurance company.

Insurers usually have a pool of policyholders at any given time. Insurers draft policies and agree to terms with policyholders. When a policyholder experiences a loss covered by the policy, they file a claim with the insurer. The insurer reviews the claim and covers the loss if it meets the policy’s terms.

Insurers are subjected to legal obligations. They, like the policyholders, are legally bound by insurance contracts. They are also regulated by government agencies, which serve to make them operate legally and fairly. If an insurer fails to process claims fairly, unreasonably denies claims, or delays payments, it may be acting in bad faith. Policyholders can take legal action against insurers for such practices.

What is Workers’ Compensation?

Workers’ compensation is a state-sponsored insurance program that provides compensation for workers suffering injury or illness. Pennsylvania workers’ compensation was mandated in the 1914 Pennsylvania Workers Compensation Act as a safety net for individuals who become injured or sick as a result of job-related duties or conditions. Workers’ compensation benefits exist to pay for medical expenses and lost wages when you suffer a work-related injury, become ill, or aggravate an existing injury or disease while on the job.

All PA employers are obligated by the Commonwealth to carry workers’ compensation insurance for their employees. Most employees are covered by workers’ compensation regardless of their status as part-time or full-time and regardless of their immigration status. Whether you are a full-time, part-time, seasonal, or immigrant worker regardless of your immigration status who was injured or became sick while on the job, […]

Can I Work While On Workers’ Compensation in Stroudsburg?

Can I Work While Receiving Workers’ Compensation Benefits in Stroudsburg?

The Pennsylvania workers’ compensation system is meant to provide support to workers after they’ve been injured on the job. It will pay all their medical costs and provide wages while the worker recovers from their injuries. In the majority of workplace injury cases, the employee will receive workers’ comp benefits until they are ready to return to work. But not all workers’ comp cases are that straightforward. In some cases, an injured worker who has not fully recovered may go back to work to perform light duty assignments. This individual will continue to have medical bills, so workers’ compensation benefits will still be available to them.

However, is it possible to collect workers’ compensation benefits and work your normal job at the same time? The answer is, yes, under certain circumstances you can work and collect workers’ comp benefits. […]
