Motorcycle Accidents in Lancaster County
Lancaster is one of the 10 PA counties with the most vehicle crashes, and the county’s major roadways including the Philadelphia and Lancaster Turnpike, US 30, US 222, PA 10 and the Lincoln Highway see devastating motorcycle accidents every year. The severity of these cases is underscored by Pennsylvania’s troubling helmet statistics, where head injury deaths in motorcycle accidents increased by 66% after Pennsylvania repealed their helmet requirement, making the pursuit of maximum compensation even more critical for victims and their families. Intersections are particularly dangerous, with 1,375 motorcycle accidents happening at intersections in Pennsylvania in 2021, almost 40% of all motorcycle accidents in the Commonwealth, and Lancaster County reporting 87 intersection accidents.
Lancaster County, Pennsylvania presents significant challenges for motorcycle accident victims seeking legal recourse. According to Pennsylvania law, an injured motorcyclist can recover damages if they are less than 51% responsible for the accident. This modified comparative negligence rule means that even if a motorcyclist bears some responsibility for their crash, they may still pursue compensation as long as their fault doesn’t exceed 50%.
From a personal injury perspective, motorcycle accident victims in Lancaster County face unique challenges when dealing with insurance companies and establishing liability. Insurance companies and adjusters often have biases against motorcyclists and cyclists, causing them to place some of the liability for the crash back on the victim – even when there is little evidence to support this. These companies may claim that riders were driving recklessly or not following traffic laws, as the more blame they can pin on you, the less they have to pay in compensation.
Establishing clear liability often requires thorough investigation and experienced legal representation. The stakes are particularly high since motorcycle accidents typically result in catastrophic injuries due to the lack of protection compared to enclosed vehicles, making comprehensive legal advocacy essential for securing adequate compensation for medical expenses, lost wages, and long-term care needs.
