Fatal Hit and Run Accidents in Luzerne County, PA
Fatal hit-and-run accidents in Luzerne County present unique legal challenges for victims’ families. Despite being only the 12th most populated region in Pennsylvania, Luzerne County ranks disproportionately high for traffic fatalities statewide. This represents a concerning increase from previous years when fatality rates were significantly lower.
Pennsylvania law provides significant protections for families affected by these tragedies through both criminal and civil channels. “Kevin’s Law,” which originated in Luzerne County, strengthened penalties for hit-and-run drivers by ensuring minimum sentences match those for DUI offenses.
For families seeking justice and compensation, Pennsylvania allows wrongful death claims independent of any criminal proceedings, with options to recover both economic damages (medical expenses, funeral costs, lost income) and non-economic damages (pain and suffering).
