Bodily Injury

What Is Bodily Injury?

Bodily injury is any physical harm inflicted on a person, including bruises, burns, cuts, poisonings, fractures, or nerve damage, among other examples.  Bodily injury can result from accidents, negligence, or intentional acts. Intentionally causing bodily harm constitutes a crime, while accidental or negligent harm can lead to legal action.

Black’s Law Dictionary defines bodily injury as “Physical pain, illness, or any impairment of physical condition.” This definition highlights that bodily injury encompasses a wide range of physical harms that can affect a person’s health and well-being.

Cases of bodily injury can range from minor injuries, such as sprains and minor cuts, to severe injuries, like traumatic brain injuries, spinal cord damage, and severe burns. Specific cases, such as Brown v. Kendall, help establish what constitutes bodily injury legally. In this case, the court focused on whether the injury resulted from negligent or intentional actions. It is important to recognize when bodily injury has occurred so that victims can understand that they are victims and ensure that they receive appropriate compensation for their medical expenses, lost wages, and pain and suffering. It also holds negligent parties accountable in order to promote safer practices to prevent future injuries.
