What is Pain and Suffering?

Pain and Suffering is a legal term that describes the physical, emotional, and mental injuries a personal injury victim sustained following an accident. 

According to Black’s Law Dictionary, pain and suffering is defined as “physical discomfort, emotional trauma, or mental anguish that a plaintiff experiences as a result of a defendant’s actions.” As such, it often refers to the non-economic damages that a plaintiff may claim to compensate for the physical pain, emotional anguish, and diminished quality of life caused by the defendant’s actions or negligence.

Pain and suffering can include physical pain or emotional distress. For example: Amy is in a car accident because the other driver drove recklessly. As a result of the accident Amy might suffer from back problems and have a panic attack every time she tries to drive a car. Therefore, not only could Amy sue the other driver for the damage to her car, but also for the  pain and suffering it has caused her physical and emotional health. Pain and suffering is aimed at providing compensation to injuried parties, and to have those at fault recognize the harm they caused and deter them from repeating their actions. Understanding pain and suffering is essential in personal injury litigation to ensure that plaintiffs receive fair and just compensation for the full scope of their injuries and losses.

Northhampton County, PA – One Dead Following Car Accident on Route 33

NORTHAMPTON COUNTY, PA (February 21, 2025) – Weather may have played a role in a deadly on Route 33 in Northampton County on February 20.

According to officials, the crash occurred just after 4:22 p.m. near the Belfast exit on Route 33 in Bushkill Township. The car went off the road and slammed into a tree.

The Northampton County coroner was called to the scene of the accident.

According to Pennsylvania State Police, the snowfall had turned heavy at that time and had caught many drivers off guard.

The investigation into the crash is ongoing.

Lycoming County, PA – One Dead, Another Injured After Car Accident on Route 220

LYCOMING COUNTY, PA (February 20, 2025) – One person is dead and another is injured following a on Route 220 in Jersey Shore on Feburary 17.

According to news reports, emergency personnel responded to a three-vehicle crash on Route 220 west of the Thomas Street exit shortly before 8 p.m. Officials say that the driver of a Subaru Forester was driving north on Route 220 when he was struck nearly head-on by a Mercedes-Benz, causing entrapment. The Mercedes then struck a truck towing a trailer and then rolled onto its roof before bursting into flames.

The driver of the Mercedes was able to pull themselves from the vehicle then fled the scene on foot where they were later reportedly struck by other vehicles in the southbound lane before the police found them. The driver was taken to the Trauma Center at UPMC for treatment. […]

Berks County PA – Driver Killed In Multi-Vehicle Accident On Route 222

BERKS COUNTY, PA (February 19, 2025) – A driver died following a multi-vehicle accident on Route 222 in Berks County on February 18.

According to the Pennsylvania State Police, the crash involved two tractor trailers and a sedan on Route 222 in Maxatawny Township near Kutztown University. The driver of the sedan was killed in the accident.

The accident shut down Route 222 for a few hours before reopening later in the day.

No word on what caused the crash or if anyone else was injured in the accident. The investigation is ongoing.
