What is a Statute of Limitations?

A Statute of Limitations is a law that dictates the timeframe in which a legal action must be pursued. As described by Cornell Law School’s Legal Information Institute, a statute of limitations is a law that “bars claims after a certain period of time passes after an injury.” After the time period dictated by a statute of limitations has passed, and no legal action has been taken following an injury or offense, no future legal action can be pursued.

The length of a statute of limitations varies by jurisdiction and claim. In Pennsylvania, the statute of limitations is two years for personal injury cases, unless the injury happened to someone who was then a minor. In that case, they would have up to two years after their 18th birthday to file a claim. The beginning of the time period in a statute of limitations in a personal injury case typically begins at the discovery of the injury. When the specified time period has passed, cases are almost always dismissed.

Statutes of limitations are meant to encourage timely action by plaintiffs. This keeps potential evidence reliable, and protects defendants from being subjected to unfair proceedings. Statutes of limitations are relevant for both civil and criminal law.

Allegheny County, PA – Tractor Trailer Overturns, Spilling Fuel on Route 28

Allegheny County, PA (February 13, 2025) – A tractor trailer overturned on Route 28 in Etna, sending one person to the hospital on February 12.

According to news reports, the truck was driving in the southbound lane of Route 28 when it hit a barrier and overturned, spilling diesel fuel onto the road and the creek below.

Emergency crews said the Department of Environmental Protection had placed a boom at the mouth of the creek so the fuel did not flow into the Allegheny River.

The driver of the vehicle was taken to the hospital after suffering injuries in the truck crash.

Lancaster County, PA – Man Dies After Van Collides with Scooter

Lancaster County, PA (February 11, 2025) – A man has died after a van collided with the scooter he was riding on with his sons in Lancaster County on February 10.

According to news reports, the man was driving a scooter that crashed around the 5800 block of the Old Philadelphia Pike in Salisbury Township around 3 p.m. Police say the man and his 15-month-old boy were taken to Lancaster General Hospital while the 6-year-old was airlifted to Penn State Health Milton S. Hershey Medical Center.

The man died at the hospital while the two boys remain in critical condition. The driver of the van was not injured.

The investigation is ongoing.
