Car Accidents While On the Job in Pennsylvania
In Pennsylvania, police officers injured in vehicle accidents while on duty are generally covered under several overlapping legal frameworks. The Pennsylvania Heart and Lung Act provides police officers with their full salary and benefits, tax-free, if they’re temporarily disabled from a work-related injury. This is more generous than standard workers’ compensation benefits, which typically only provide about two-thirds of the regular salary.
Police officers have additional legal protections under Pennsylvania’s Workers’ Compensation Act. Unlike the Heart and Lung Act benefits, workers’ compensation can continue even if the disability becomes permanent. These benefits can run concurrently with Heart and Lung Act benefits.
If another driver’s negligence caused the accident, the injured officer may also have the right to pursue a third-party liability claim against the at-fault driver, even while receiving the Heart and Lung Act and workers’ compensation benefits. This is significant because it allows recovery for damages not covered by workers’ compensation, such as pain and suffering.
