Plane Accidents in Pennsylvania
Plane crashes in Pennsylvania involve complex legal considerations that affect both victims and their families.
Pennsylvania follows modified comparative negligence rules, meaning compensation can be reduced based on a plaintiff‘s degree of fault, but they can still recover damages if they’re less than 51% responsible. The state also has a two-year statute of limitations for filing personal injury claims related to aviation accidents.
Aviation accident cases in Pennsylvania typically involve multiple parties including aircraft manufacturers, maintenance providers, pilots, airlines, and potentially government entities if air traffic control errors contributed. This creates a complex web of liability that requires specialized legal expertise.
Damages available to Pennsylvania plane crash victims include medical expenses, lost wages, pain and suffering, and in wrongful death cases, funeral expenses and loss of companionship. Pennsylvania courts may award punitive damages in cases involving extreme negligence or misconduct.
Federal regulations and agencies like the NTSB and FAA play significant roles in these cases, often conducting investigations that become crucial evidence. The Montreal Convention may apply to international flights, potentially limiting liability but establishing certain presumptions that can benefit plaintiffs.
