What is Full Tort Insurance?

Full tort insurance is an auto insurance option in Pennsylvania that allows the injured party to file a personal injury lawsuit against the at-fault party for pain and suffering damages. 

According to the Pennsylvania Insurance Department, full tort insurance “Provides unrestricted rights to bring a lawsuit against a negligent party and seek full compensation for all damages, including pain and suffering, without limitation.” Full tort insurance coverage is comprehensive in nature, granting policyholders extensive legal rights in the event of an accident. Unlike limited tort insurance, which restricts the ability to recover non-economic damages unless the injuries meet a certain severity threshold, full tort insurance provides broader legal recourse for the insured to include non-economic harms that may not be covered under limited tort insurance, such as emotional or psychological distress.

 For example, if a driver with full tort coverage is involved in a collision caused by another driver’s negligence, they can sue for all damages, including those for emotional and psychological impact, not just medical expenses and lost wages. The benefits of full tort insurance include the ability to seek complete compensation for all damages suffered, which can be important for individuals facing significant pain and suffering or emotional distress after an accident. However, there are potential detriments, such as higher insurance premiums compared to limited tort coverage and the possibility of lengthy and complex legal processes when pursuing a lawsuit.
