Police Chase Car Accidents in Pennsylvania

Car accidents involving police chases present unique legal challenges in Pennsylvania, often resulting in serious injuries to innocent bystanders caught in dangerous situations. Most police chases begin with relatively minor violations rather than serious crimes. According to the International Association of Police Chiefs, 91% of law enforcement pursuits begin in response to a non-violent crime, with nearly half initiated because of traffic violations, including speeding Pennsylvania State Police Announce Pursuit Statistics. Pennsylvania State Police policy permits pursuits regardless of the initial violation’s severity, though only 15.6 percent of apprehended drivers were ultimately charged with a violent crime.

From a legal standpoint, victims of police chase accidents have several potential avenues for compensation, though these cases involve complex liability determinations. Pennsylvania law requires claims involving police parties to be filed within two years. While fleeing drivers typically bear primary responsibility for accidents, police officers are protected by Pennsylvania law, though agencies may face liability if officers violated pursuit policies. Pennsylvania’s choice no-fault insurance system also affects how these cases are handled, depending on whether victims selected limited tort or full tort coverage when purchasing their policies.
