On Thursday, October 8, Attorney Daniel Munley, partner at Munley Law Personal Injury Attorneys, spoke at the American Association for Justice (AAJ) Advanced Trial Advocacy College on Litigating Truck Collision Cases, held in Dallas, TX. Dan’s presentation was titled, “The Mechanics of the Mechanical Case – From Intake Through Trial.”

Dan Munley Speaks Up for Victims of I 380 Tractor Trailer-Bus Crash as Investigation Continues
Yesterday, Interstate 380 was shut down by a deadly crash between a tractor trailer and a charter bus in Monroe County. According to the state police, the tractor trailer crossed the median and hit the bus head on. Three people, including the bus driver, were killed, and 13 more were taken to area hospitals to be treated for injuries. Nine were taken to Pocono Medical Center, and the rest were treated at Geisinger trauma centers.
According to WNEP, The Academy Viaggidea charter tour bus was carrying a group of Italian tourists on their way to visit Niagara Falls. The driver of the tractor trailer has been identified as Franklin Wyatt from Oklahoma. His truck is registered to XTRA Lease Trucking of St. Louis.

Munley Law Personal Injury Attorneys Reaches $3.97 Million Settlement in Tractor Trailer Case
(May 2015 – Scranton, PA) – Munley Law Personal Injury Attorneys today announced a $3.97 million settlement in a case stemming from a tractor trailer accident in January, 2011. Plaintiff, Allison Kowalski, whose husband, Mark Kowalski, was killed, was represented by Attorneys Daniel Munley and Marion Munley of the Munley firm.
Mr. Kowalski, from New York state, was traveling east on I-80 in Columbia County, PA, when he encountered defendant Patrick Webb, a Texas truck driver who was also traveling eastbound on I-80. Webb was driving for PBM, a Texas trucking company. The trailer he was hauling was leased to PBM by Republic National Industries of Texas.
Webb lost control of his rig on the snow-covered highway, and his tractor slid off of the road and into the median. Kowalski, who was traveling behind Webb, was unable to avoid a collision with Webb’s trailer which was blocking the eastbound lanes of traffic. […]

Follow Up: Supreme Court Hears UPS Pregnancy Discrimination Case
Wednesday, the Supreme Court finally issued an opinion on the pregnancy discrimination case brought against UPS, siding in favor of former employee Peggy Young.
At the end of last year, we blogged about Peggy Young, the former UPS driver who brought a pregnancy discrimination lawsuit against United Parcel Service nearly ten years ago. When Young became pregnant with her third child, her doctor advised her that she should not lift more than 20lbs. Because her job duties required her to sometimes lift up to 70lbs, Young requested light duty assignment, which was available for other employees who could not perform their normal job duties due to a work injury, disability, or suspension of their Dept. of Transportation certification. Her request was denied and placed on unpaid medical leave.
Young sued under the Pregnancy Discrimination Act which says, “women affected by pregnancy, childbirth, or related medical conditions shall be treated the same … as other persons not so affected but similar in their ability or inability to work. […]

Working multiple jobs increases risk for injury
Do you have more than one job?
Approximately 14 million Americans do. According to a recent study by the Liberty Mutual Research Institute, people who hold more than one job are at an increased risk for workplace injuries. The LMRI study, published in the American Journal of Public Health, found that working multiple jobs increases the risk of injury (both at work and not at work) by 27%.
The researchers looked at 15 years of data from the National Health Interview Survey conducted by the Census Bureau and compared information on American adults who held multiple jobs and those who only held one. They discovered that the 14 million people working more than one job were 27% more likely to suffer an injury.

Munley Law Announces $750k Settlement for Truck Accident Victim
Victim to receive compensation for injuries sustained in truck accident
Munley Law Personal Injury Attorneys announced Friday that a $750,000 settlement has been reached in a tractor trailer accident case which was scheduled to go to trial this month before the Honorable Robert D. Mariani, United States District Court Judge for the Middle District of Pennsylvania in Scranton.

Thousands of workers die from injuries inflicted at work each year. According to the Occupational Safety & Health Administration (OSHA), 4,405 workers died on the job in 2013. Dr. David Michaels, Assistant Secretary of Labor for OSHA said that “making a living shouldn’t have to cost you your life. Safe jobs happen because employers make the choice to fulfill their responsibilities to protect their workers.”
MSN News recently published America’s 10 Deadliest Jobs. The job with the highest fatality rate according to that list is Loggers. This is the 2nd year that loggers have topped the list of fatal jobs.

Last Friday, Nov. 14, U.S. Representative Matt Cartwright was elected Regional Whip by his Democratic colleagues. $3.8 million settlement reached for victim of tractor-trailer crash
Man struck by two separate tractor trailers causing permanent injuries
On Friday, October 24, a $3.8 million settlement was reached weeks before it was scheduled to be tried in a Lackawanna County court. Kyle Kelly filed suit against two trucking companies and their drivers following a crash that occurred in July of 2010, in the southbound lanes of Interstate 380 near the Pocono Pines exit. Kelly alleged that both drivers and their companies were negligent.
Kelly, then 23, was traveling home from work on Interstate 380 southbound at around 3:30 a.m. when his vehicle was struck by a tractor-trailer owned by Proud 2 Haul and operated by Isabel Lopez. OSHA tightens standards on workplace injury reporting
Last month, the US Occupational Safety and Health Administration (OSHA) strengthened the rules that required businesses to report serious workplace injuries and fatalities. Their goal is to uncover workplace hazards faster and fix problems sooner by requiring companies to report more on-the-job injuries to federal regulators.
According to OSHAs revised safety rule, effective January 1, 2015, companies will be required to report all work-related in-patient hospitalizations, amputations, and eye losses within 24 hours. Current laws only require employers to report in-patient hospitalizations if three or more employees are affected, and amputations and eye losses do not have to be reported. Remaining unchanged is the requirement that employers report work-related fatalities within eight hours.

A jury returned a verdict in the amount of $200,500 in favor of Sandra Seamans of New Milford, Pa. on Wednesday, September 10, 2014, following three days of testimony before the Honorable Malachy Mannion. Mrs. Seamans claimed she was injured following a rear-end automobile accident that occurred in 2011 on I-81 South near Exit 223.
The Defendant in the case was Universal Technical Institute and its employee. The verdict awarded damages to Mrs. Seamans for wage loss and pain and suffering resulting from chronic neck and back pain that she suffered in the accident. We are thrilled with the verdict,” said lead attorney, Marion Munley. “Justice was served.”

$2,050,000 settlement reached in Wayne County pedestrian accident case
Engineers concluded the intersection was unnecessarily dangerous for pedestrians
On average, a pedestrian was killed every 2 hours and injured every 7 minutes in traffic crashes in 2012, the most recent year for which data was available. According to the National Highway Traffic Safety Administration (NHTSA), 4,743 pedestrians died in traffic crashes in 2012 and an estimated 76,000 pedestrians were injured. The NHTSA reported that fatalities among pedestrians increased for the third consecutive year (6.4% over 2011).
On August 27, a $2,050,000 settlement was reached in a wrongful death case scheduled to go to trial in Wayne County, Pa. The accident involved the death of 60-year-old Ruthann Malti who was struck and killed by a Ford pickup truck on the corner of 7th and Church Streets in downtown Honesdale, Pa.
