What is a Claim?
A claim is a legal action concerning physical or mental harm suffered by the plaintiff due to the defendant’s negligence. In the case of insurance claims, it is a request made by the insured to the insurance company for coverage and compensation for damage or injury. A claim is sometimes also referred to as a Cause of Action.

What is a Claim?
Cornell Law School’s Legal Information Institute defines a claim as, “a set of operative facts creating a right enforceable in court.” Making a claim is how the process of a plaintiff filing a lawsuit and eventually receiving damages from a defendant begins. A claim must be present in order for a lawsuit to go forward. If one is not present in a specific instance, then that lawsuit will be dismissed. Examples of types of claims include claims to insurance companies, personal injury claims in cases of negligence, claims on breaches of contract, property claims, and employment claims such as unpaid wages, wrongful termination, or discrimination. A defendant may make a counterclaim against the claim of a plaintiff.
Claims can sometimes be dismissed even if there is an intent to file a lawsuit. Rulings in cases such as Ashcroft v. IQBAL and Bell Atlantic v. Twombly have determined that claims need to contain important information. They must be plausible on their own and establish a likelihood of liability. This is how claims can lead to fair compensation, resolution of disputes, and protection of rights.

Cumberland County, PA (February 6, 2025) – One person was taken to the hospital following a multi-vehicle accident in Cumberland County on February 5.
According to news reports, the crash occurred on PA 114 westbound at the Honey Locust Drive and Old Willow Mill Road intersection. Witnesses say that EMS had treated victims at the scene of the accident. One person was seen taken out on a stretcher.

Harrisburg, PA – Man Flees Traffic Stop, Causing Six-Car Accident
Harrisburg, PA (January 29, 2005) – A man trying to flee a traffic stop caused a multi-vehicle accident on January 26 in Harrisburg.
According to the Pennsylvania State Police, troopers pulled over the driver on 17th Street in Harrisburg and noticed he was trying to hide items as they asked for his ID. When the man refused to leave the vehicle, investigators say the trooper tried to break the window.
The man then reversed his SUV into the police cruiser and drove off, hitting another car on 21st Street and causing a six-vehicle crash. He was taken into custody.

Wrong-Way Car Crash Leaves Multiple Injured in Cumberland County, PA
Multiple people were injured following a wrong-way crash along U.S. Route 15 in Cumberland County on January 18.
According to news reports, the accident occurred around 4:40 p.m. on the northbound side of the road. According to the Upper Allen Township Police Department, the vehicle had entered the northbound lanes near mile marker 41.5 and traveled south for at least four miles before the crash.
Police say the wrong-way driver struck at least four other vehicles around mile marker 37. As emergency personnel responded to the scene, both north and southbound sides of Route 15 were shut down.

Uber Passenger Dies After Driver Crashes Into Tractor Trailer in Philadelphia
An Uber passenger died after her Uber driver crashed into a tractor trailer on December 31 in Philadelphia. According to news reports, the crash happened at Nedro and Ogontz Avenues around 10:45 p.m. when the driver crashed the vehicle into a parked truck.
