What is a Judgment?

A judgment is the final part of a court case that resolves all the contested issues and terminates the lawsuit; a final decision is made about the rights and claims of each side in a lawsuit.

According to Black’s Law Dictionary, judgment is defined as “a court’s final determination of the rights and obligations of the parties in a case,” demonstrating  the authoritative nature of a judgment as the culmination of legal proceedings, which resolves disputes and establishes legal consequences. Judgments can vary in nature, including judgments on liability, damages, and equitable remedies, depending on the type of legal action and the issues presented.

Judgements can often make changes in the law that can have ripple effects throughout the nation. Specific cases, such as Brown v. Board of Education, exemplify landmark judgments that have had profound impacts on civil rights and legal precedents. Understanding the concept of judgment is essential for navigating the legal system, whether as a party directly involved in litigation, a legal professional, or a member of the public seeking to comprehend legal outcomes and their implications.

According to the U.S. , every 2-hours, three people are killed in this country in alcohol-related highway crashes. The National Highway Traffic Safety Administration (NHTSA) reported 33,561 crash fatalities in 2012, of those 31% or 10,322 involved a drunk driver. This was a 4.6% increase from the previous year.

In 2012, 239 children age 14 and younger were killed in alcohol-impaired driving crashes. Of those, 124 were in the vehicle with a drunk driver. Pennsylvania residents should be on guard against Superstorm Sandy-related home repair scams.

Unqualified contractors, high-pressure sales pitches and price gouging are on the upswing – and unwary homeowners are paying the price.

The situation has prompted state Attorney General Linda Kelly to issue a consumer warning:

Triple Fatal Accident Serves as a Reminder to Pennsylvania Drivers of the Dangers of Drowsy Driving

An early morning accident on Saturday left three people dead and two others seriously injured after the driver apparently fell asleep behind the wheel.  The single-car crash occurred around 2:15 a.m. on I-81 north near Butler Township after the car traveled across the grass median and slammed into the concrete bridge support beam.

The National Highway Traffic Safety Administration (NHTSA) reports that accidents cause more than 100,000 crashes a year, resulting in 40,000 injuries and approximately 1,550 deaths.  However, the NHTSA believes these numbers are actually much higher due to underreported drowsy driving accidents.

One of the leading causes of drowsy driving is shift work.  With irregular hours, long shifts, and disrupted sleep patterns, the NHTSA reports shift workers run a particularly high risk of drowsy driving crashes.

$1.7 Million Judgment Against Johnson & Johnson Following Injury Due To Drug

Failure to warn patients about potential tendon damage due to drug use leads to lawsuit

A Minneapolis jury has awarded an 82-year-old man $1.1 million in punitive and $630,000 in compensatory damages against Johnson & Johnson for failing to warn patients its antibiotic, Levaquin, may cause tendon damage, reports the Star Tribune.

The case in U.S. District Court is the first of thousands of lawsuits filed nationwide by patients who tendon injuries after taking Levaquin.  This man was an active golfer and a mall-walker before rupturing or partially rupturing both Achilles tendons after taking Levaquin and a steroid for bronchitis five years ago – unaware of the risks with the drug combination.

The lawsuit was filed in 2008 against Johnson & Johnson and its Ortho-McNeil-Janssen Pharmaceuticals unit for failing to warn doctors and patients of Levaquin’s potential for tendon damage. […]
