What are Parties?

Parties are individuals, corporations, or associations involved in a lawsuit as plaintiffs or defendants.

According to Black’s Law Dictionary, parties are defined as “persons or entities actively participating in a transaction or proceeding.” Due to the formal nature of the proceedings, each party has specific rights, duties, and interests related to the legal matter. Parties can include plaintiffs or those bringing the lawsuit, and defendants, those who refute the allegations; they can also include third-party defendants who are asserted as being partially responsible for the plaintiff’s claims. 

The most important responsibility of a party is the burden of proof. In a civil case, this falls to the plaintiff.  Understanding the roles and identities of the parties is crucial for determining legal responsibilities, enforcing rights, and reaching resolutions in disputes.

Clergy abuse report blocked by PA Supreme Court

PA Supreme Court blocks grand jury report’s public release

The Pennsylvania Supreme Court stopped the release of a grand jury report investigating decades of sexual abuse in six Catholic dioceses across the state as a result of challenges filed by unnamed .  While the report was issued to six dioceses under investigation, no estimated date has been provided for when the 800 plus-page report will be made public.

The grand jury spent nearly two years investigating allegations of sexual abuse by the clergy in Allentown, Erie, Greensburg, Harrisburg, Pittsburgh and Scranton.  These dioceses have roughly 1.7 million members.

The investigation covered not only claims of child sexual abuse, but also failure to report to law enforcement and obstruction of justice.  In addition to the clergy, clergy community leaders, local public officeholders, and church officers were investigated.   […]

Uber will no longer force assault victims to arbitration

uber Uber will no longer force the use of private for riders, drivers or employees who that they have been sexually assaulted or harassed.  Rather, these cases can now be brought to court and be heard by a jury.

Until now, riders waived their constitutional right to a trial when they signed Uber’s user agreement. Now, anyone who claims that they have been sexually assaulted or harassed as an Uber rider, driver, or employee can have their individual cases brought to court and be heard by a jury. Uber will also end the requirement that victims who accept settlements through arbitration must sign confidentiality agreements that prevent them from talking about their experiences.

The policy change does not include other forms of harassment.

Bipartisan Underride Bill Could Prevent Deadly Crashes

Truck underride bill to require new safety standards

Lawmakers from both recently introduced a potentially life-saving bill to mandate that underride guards be installed on the front and sides of large trucks. The Stop Underrides Act of 2017 was introduced by Sen. Kirsten Gillibrand (D- N.Y.) and Sen. Marco Rubio (R-Fla.) as well as Reps. Steve Cohen (D-Tenn.) and Mark DeSaulnier (D-Calif.).

Under the current federal law, underride guards are only required for the back of trucks. The proposed bill would also require an update of the outdated standards for underride guards on the rear of a truck. Guards would be required to be tested and would need to prevent a vehicle traveling at 35 mph from sliding under a tractor trailer. The standard would apply to single-unit trucks, semis and trailers weighing more than 10,000 lbs.
