Personal Injuries

What are Personal Injuries?

Personal injury law covers claims where someone is injured physically, mentally, or emotionally as a result of another party’s negligent actions. It is often better known as tort law.

According to Black’s Law Dictionary, personal injury is defined as “any harm caused to a person, such as a broken bone, a cut, or a bruise; also, bodily injury, as opposed to injury to property.” Therefore, personal injuries are directly associated with torts, or the harm caused to a person due to the negligence, recklessness or intentional actions of another party. This legal term encompasses a wide range of situations where an individual suffers harm and can seek compensation through legal action to cover medical expenses, lost wages, pain and suffering, and other related damages.

Most often, personal injury cases involve car accidents, slip-and-fall incidents, medical malpractice, product liability, or workplace injuries. A particularly renowned personal injury case is the “Hot Coffee case”, Liebeck v. McDonald’s Restaurants. After Liebeck received burns from hot coffee she sued McDonalds, which lacked signage for the hot coffee. Liebeck was awarded a significant amount for her personal injury. As we can see in the Liebeck case, when personal injuries occur, a lawsuit helps give the injured compensation, while also holding negligent parties accountable. Understanding personal injury law is essential for individuals to protect their rights and secure fair compensation when harmed by another’s actions.
