What is Mediation?

Mediation is, “The act of a third person who interferes between two contending parties with a view to reconcile them or persuade them to adjust or settle their dispute.” (Black’s Law Dictionary 1133. 4th Ed. Rev. 1968)

Mediation is a form of Alternative Dispute Resolution (ADR), serving as an alternative to a jury trial. It begins with a legal dispute between two neutral parties. The parties then decide to proceed with a neutral third party known as a mediator overseeing them. The mediator attempts to help reach a mutually agreeable settlement in a private setting. Mediation is somewhat similar to arbitration, though there are differences. Mediation is non-binding, less formal process. Unlike in arbitration, a mediator does not come to any conclusion themself. A mediator has no real legal power over either party. Because of this, the mediator can communicate with both sides in ways that a judge or an arbitrator can’t, and can use creative methods to find mutually acceptable solutions that might not otherwise emerge.

A mediator only attempts to have two parties reach an agreement. Unlike others forms of ADR, if no agreement is met, the dispute will simply move forward to trial or another kind of resolution in the end. Mediation is a cheap, flexible way to attempt to solve a dispute, but not very strong.

Roundup lawsuits continue to make headlines

In the last few years, makers of the popular weedkiller Roundup have faced thousands of lawsuits alleging that their product caused cancer. Now, more than 18,000 claimants have filed suit.

Claimants allege that exposure to glyphosate, the ingredient found in Roundup, caused them to develop non-Hodgkin’s lymphoma. Furthermore, they allege that Monsanto, makers of Roundup, knew about the risks of their product and failed to issue appropriate warning to consumers.

As of August 9, 2019, three cases against Monsanto have gone to trial. All three cases have resulted in massive awards for plaintiffs. Even after judges reduced the amounts recommended by juries, the verdicts were significant. For example, in July, a California judge reduced a couple’s $2 billion to $87 million.

New York Man Awarded $1.5 Million After Debilitating Auto Accident

A man who suffered “a permanent, significant physical limitation” as the result of a serious automobile accident on Route 104 in Ontario, New York, has been awarded over $1.5 million by a Monroe County Supreme Court jury.

The man was stopped at a stop light in 2009 when he was hit from behind by another vehicle.  He was diagnosed with acute lumbar spine injuries.  The ‘s company, State Farm Mutual Automobile Insurance Co., offered to settle the case for $5,000 and refused or to settle the case, forcing the case into trial.

InsuranceNewsNet.com reports the man was awarded $1.25 million in past, present and future and of enjoyment of life, along with $321,250 in past and future medical expenses.
